Last updated: [DATE TO BE SET AT PUBLISH]

These Terms of Use govern your access to and use of the EverCare Advisors website (evercareadvisors.com) and our placement services. By using the site or engaging our services, you agree to these terms.

Draft status: These terms are a working draft. Final language must be reviewed by legal counsel before the site’s full public launch.

1. Our services

EverCare Advisors is a senior-care placement advisor serving families in Pierce County and South King County, Washington. We help families identify adult family homes, assisted living facilities, and memory care communities that fit their specific needs. We are not a licensed care provider; we do not operate the homes we recommend. See our disclosure for the full explanation of how our services and compensation work.

2. No professional advice

Content on this site is educational and informational. It is not legal, medical, financial, or tax advice. Regulatory figures (Medicaid asset limits, VA benefit rates, WAC citations) reflect amounts current at the time of writing and may change. For decisions with legal, medical, or financial consequences, consult a licensed professional — an elder-law attorney, physician, certified financial planner, LTC insurance specialist, or VA-accredited claims agent as appropriate.

We may refer you to specific professionals in these fields. Referrals are provided as a convenience and not as an endorsement. You remain responsible for evaluating any professional’s qualifications and fit for your situation.

3. No guarantee of outcomes

We provide recommendations based on our understanding of a family’s situation and the homes we have vetted. We cannot guarantee that any specific home will have availability at the time of tour, will accept a specific resident, will deliver a specific quality of care, or will meet any particular expectation. Homes’ staffing, conditions, and policies change. We update our recommendations as conditions change, but no shortlist is a guarantee.

Final decisions about care placements rest with the family. You agree that you are exercising independent judgment in choosing a home and that our role is advisory, not decisional.

4. Intake information

When you complete our intake forms or provide information during our consultation, you represent that the information is accurate to the best of your knowledge and that you have authority to share it (for example, power of attorney or next-of-kin status when providing information about a care recipient).

We handle the information you share per our privacy policy. We do not share contact details with specific homes without your prior authorization.

5. Communications consent

By submitting our intake forms, you consent to be contacted by phone, email, or SMS about your care-search request. Consent to be contacted is not a condition of service — you can change how we contact you or opt out entirely at any time. Message and data rates may apply for SMS. Reply STOP to any SMS to unsubscribe.

6. Website content

All content on evercareadvisors.com is the property of EverCare Advisors or used with permission. You may share links to our pages, quote content with proper attribution for non-commercial purposes, and print pages for personal reference. You may not copy, reproduce, or republish our content in bulk without written permission.

If you notice factual errors or outdated information on the site, please email advisor@evercareadvisors.com. We update pages as regulations and conditions change.

7. Third-party links

Our site links to external resources (DSHS.wa.gov, VA.gov, Pierce County government, healthcare systems, etc.). We don’t control these sites and aren’t responsible for their content, privacy practices, or accuracy at any moment in time. Verify critical information against the external source’s current state.

8. Limitation of liability

To the fullest extent permitted by Washington law, EverCare Advisors is not liable for any indirect, consequential, incidental, or punitive damages arising from your use of the site or engagement with our services. Our maximum liability in any single matter is limited to the amount you paid us directly — which, since we do not charge families, is typically zero. This limitation does not apply to liability that cannot be limited by law (gross negligence, willful misconduct, personal injury caused by our actions, etc.).

9. Governing law and disputes

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-law principles. Disputes arising from these Terms or our services will be resolved in the state or federal courts located in Pierce County, Washington.

Consumer complaints about business practices may also be filed with the Washington State Attorney General’s Consumer Protection Division (1-800-551-4636). Complaints about licensed care facilities we refer to may be filed with the DSHS Complaint Resolution Unit (1-800-562-6078).

10. Changes to these terms

We may update these Terms from time to time. Material changes will be noted through a banner on the site or via direct email to families actively engaged in our services. Your continued use of the site or services after a change constitutes acceptance of the updated Terms.
